These Terms of Service ("Terms") govern your use of applications developed and published by Elephatech ("we," "us," or "our") on the monday.com marketplace, including Board Heatmap. By installing or using our apps, you agree to these Terms.

1. Acceptance of Terms

By accessing or using any Elephatech application, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not install or use our applications.

2. Description of Service

Elephatech provides productivity and visualization tools that operate as third-party applications within the monday.com platform. Our apps access your monday.com board data in read-only mode to provide visualization and analytics features.

3. Read-Only Access

Our applications access your monday.com board data strictly in read-only mode. We do not create, modify, or delete any items, columns, groups, or other data on your boards. Any data displayed by our apps is sourced directly from your existing monday.com board data.

4. monday.com Platform

Our applications operate within and depend upon the monday.com platform. Your use of monday.com is subject to monday.com's own Terms of Service and Privacy Policy. We are not responsible for the availability, functionality, or policies of the monday.com platform. Changes to the monday.com platform may affect the functionality of our applications.

5. Pricing and Payments

Some features of our applications may be offered under free and paid tiers. Pricing information is available on the monday.com marketplace listing for each app. We reserve the right to modify pricing with reasonable advance notice. Payments are processed through monday.com's marketplace billing infrastructure.

6. Disclaimer of Warranties

Our applications are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our applications will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Elephatech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use our applications.

8. Intellectual Property

All content, design, code, and intellectual property in our applications remain the property of Elephatech. You are granted a limited, non-exclusive, non-transferable license to use our applications in accordance with these Terms and the monday.com marketplace terms.

9. User Responsibilities

You are responsible for maintaining the security of your monday.com account and ensuring that your use of our applications complies with all applicable laws and regulations. You agree not to reverse engineer, decompile, or attempt to extract the source code of our applications.

10. Termination

You may stop using our applications at any time by uninstalling them from your monday.com workspace. We reserve the right to suspend or terminate access to our applications at any time, with or without cause, and with or without notice.

11. Changes to Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated revision date. Continued use of our applications after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
