By installing or using any application ("App") developed and published by Elephatech ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not install or use our Apps.

2. Description of Services

Elephatech develops and publishes marketplace apps for third-party platforms including monday.com, Zendesk, and others. Our Apps are designed to enhance your experience on these platforms by providing additional visualization, productivity, and data tools.

Our current Apps include Board Heatmap (monday.com) and Quick Charts (Zendesk), with additional apps published over time.

3. Read-Only Access

Our Apps access data from the host platform in read-only mode unless explicitly stated otherwise in the App's description. Our Apps do not modify, delete, or create data on the host platform except where the App's core functionality requires it (e.g., saving user preferences via platform-native storage).

Our Apps operate within and depend on third-party platforms (monday.com, Zendesk, etc.). We do not control these platforms and are not responsible for:

Elephatech does not directly process payments or store payment information. Refund policies are governed by the respective platform's marketplace terms.

6. Disclaimer of Warranties

Our Apps are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our Apps will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Elephatech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of our Apps, regardless of the theory of liability.

Our total liability for any claim arising from or related to these Terms or your use of our Apps shall not exceed the amount you paid to us (if any) for the App in question during the twelve (12) months preceding the claim.

All intellectual property rights in our Apps, including but not limited to code, design, documentation, and trademarks, are owned by Elephatech. You are granted a limited, non-exclusive, non-transferable license to use our Apps in accordance with these Terms and the respective marketplace's terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Elephatech operates, without regard to conflict of law principles.
